By accessing and using dataPdf ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, do not use the Service.

2. Description of Service

dataPdf provides PDF table extraction services, converting PDF documents into structured data formats (Excel, CSV, JSON). The Service uses a dual-pipeline approach combining OCR and text extraction for enhanced accuracy.

3. Account Responsibilities

3.1 Account Creation

To use the Service, you must create an account. You agree to:

Provide accurate and complete registration information
Maintain the security of your account credentials
Promptly update any changes to your information
Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for maintaining the confidentiality of your password and account. Notify us immediately of any unauthorized use or security breach.

4. User Content and Intellectual Property

4.1 Your Content

You retain all ownership rights to the PDF documents you upload ("Your Content"). By uploading documents, you grant us a limited license to process them for the purpose of providing the Service.

4.2 Our Technology

The Service, including all software, algorithms, and processes, is the intellectual property of dataPdf. You agree not to:

Reverse engineer, decompile, or disassemble any part of the Service
Copy, modify, or create derivative works
Remove any proprietary notices or labels

5. Payment Terms

5.1 Pricing

The Service offers both free and paid tiers. Pricing is displayed on our website and may be modified with 30 days' notice.

5.2 Subscription

Paid subscriptions renew automatically unless cancelled. You may cancel your subscription at any time through your account settings.

5.3 Refund Policy

Refund Policy: We offer a 14-day money-back guarantee for new paid subscriptions. If you're not satisfied, contact support@datapdf.io within 14 days of your first payment for a full refund. After 14 days, refunds are handled at our sole discretion.

6. Acceptable Use

You agree not to use the Service to:

Upload illegal, harmful, or infringing content
Attempt to gain unauthorized access
Interfere with or disrupt the Service
Use the Service for any illegal purpose
Resell or redistribute the Service without authorization

7. Limitation of Liability

IMPORTANT - PLEASE READ CAREFULLY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Liability Cap: OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM. THIS CAP APPLIES TO ALL CLAIMS, INCLUDING BUT NOT LIMITED TO BREACH OF CONTRACT, TORT, OR STATUTORY CLAIMS.
No Consequential Damages: WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
"As-Is" Basis: THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

8. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. EXTRACTION ACCURACY DEPENDS ON THE QUALITY AND FORMAT OF YOUR INPUT DOCUMENTS.

9. Indemnification

You agree to indemnify, defend, and hold harmless dataPdf and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

Your use of the Service
Your violation of these Terms
Your Content uploaded to the Service

10. Account Termination

10.1 Termination by You

You may terminate your account at any time through your account settings.

10.2 Termination by Us

We may suspend or terminate your account if:

You breach these Terms
You violate our Acceptable Use Policy
Your payment fails and remains outstanding
We are required by law

10.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We will delete your uploaded documents within 30 days of termination. Certain provisions survive termination (Limitation of Liability, Indemnification, Dispute Resolution).

11. Dispute Resolution

11.1 Informal Resolution

We encourage you to contact us directly to resolve any dispute. Email support@datapdf.io with your concern.

11.2 Arbitration

Any dispute not resolved informally will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration will be conducted in English, and the seat of arbitration will be in the jurisdiction where our business is registered.

11.3 Small Claims

Notwithstanding the above, you may bring claims in small claims court if your claim qualifies.

11.4 Class Action Waiver

You agree to resolve disputes individually. You waive any right to participate in class actions or representative proceedings.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which our business is registered, without regard to conflict of law principles.

13. Changes to Terms

We may modify these Terms at any time. We will provide 30 days' notice of material changes via email or website notice. Your continued use after the notice period constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and dataPdf regarding the Service, superseding any prior agreements.
